- Terms of Sale

txttouch is registered in England and Wales under company number 5890361 and registered office is at 9-10 St Mary’s Place Shrewsbury Shropshire SY1 1DZ and whose VAT number is 889940448.

- Service

The text bundle described overleaf ('this Service') cannot be used in conjunction with any offer or promotion unless specified otherwise.  The  texts roll over from one calendar month to the next until you have used the bundle of texts which you have ordered. Please note that the texts will expire if six months elapses from the last use of the service by you. The text messages will be standard text messages to any mobile phone network based in the United Kingdom and no premium rate services shall apply unless otherwise advised to you in writing. You will not be obliged to accept such additional premium rate services.

You may obtain a renewal of the bundle of texts by placing an order via www.txttouch.com, or by using a new order form which you may obtain from your txttouch agent.

txttouch reserves the right to amend the terms and conditions of this agreement or to withdraw or vary this Service at any time.  Any such amendments or variations shall be displayed on www.txttouch.com.

- Price

This Service provided by txttouch Limited is subject to availability.  Where this Service is no longer available, or where certain prices have changed, txttouch will use its reasonable endeavours to update the relevant information on www.txttouch.com as soon as practicable.  However, no price, or other information displayed to you by txttouch or a txttouch agent will bind txttouch ltd until txttouch ltd has accepted your order as described below.  The price you will be charged for this Service will be the price in force when your order is accepted by txttouch ltd.

- Placing An Order

Any order which you  place with us for the purchase of this Service constitutes an offer for this Service by you.

txttouch will only accept your order if you supply us with a registered office or trading address within the United Kingdom. txttouch can only accept orders from persons aged 18 years or older and who are residents of the United Kingdom.

If txttouch does accept your order, a contract will be created at the time you provide confirmation in writing of your order by signing the order form. You will receive a copy of the signed order form from txttouch or txttouch agent at this point.

- Delivery

txttouch will normally set up the system for you to be able to send text messages to your customer within 7 to 14 working days from the date of receipt of cleared funds from you.

txttouch may alter the 80480 shortcode number at any time at its discretion  and where possible on 30 days’ notice in writing of any such alteration. Any selection of your keyword under paragraph b overleaf is not guaranteed and txttouch. reserves the right to provide a replacement keyword. txttouch also reserves the right to terminate your use your selected keyword at any time on 30 days’ written notice and provide you with the nearest available alternative keyword.

If you fail to make payment for this Service described overleaf txttouch shall terminate this Service forthwith.

- Text Messages

You shall not use this Service or any other service which txttouch may provide to you for sending any communication or storing any data which is of an offensive, abusive, indecent, misleading or obscene nature. You will be responsible for informing any subscriber of the costs associated to joining or using your txttouch service, including standard rate texts or premium rate texts, this information must be included with any promotional materials or invitations to join your txttouch service. If a complaint about your service is lodged with txttouch or ICTIS and upheld you will indemnify txttouch of any loss and take responsibility for any corrective action or compensation, in regards to the service you have provided to your customers.

- Disclaimer

txttouch will not be liable for any loss of profits, loss of data or consequential losses arising from your use of, or inability to use or access this Service, or following a failure, suspension or withdrawal of all or part of this Service at any time.

- Termination

Any customer on your mailing list who is using this Service provided to you by txttouch has the right to terminate this Service at any time by texting STOP or STOP + (your selected keyword) to the shortcode. A helpline is provided to you as a subscriber to this Service on 08706 260684 and calls made to this number shall be charged at national rate where such calls are made from a landline. If you call from your mobile costs will vary and you may be charged more.
As an individual text message will only consist of 160 characters txttouch may be required to use a number of these characters to advise subscribers (1) how to stop this Service or  (2) to inform your customer of any additional charges which may arise as a result of their subscription to additional premium rate services provided by txttouch. Only one message will be sent per individual communication unless otherwise stated.

- Cancellation Policy

Once an order has been received, txttouch does not provide any facility for cancellation.  Refunds are not provided with this service.  This does not affect your statuary rights.
